1. Privacy Policy

This Privacy Policy references our policies and procedures on the collection, use and disclosure of your personal information whilst using the Service. This policy further aims to inform the user on his/her rights to privacy and the laws which protect such privacy rights.
By using the Service, the user agrees to collection and use of information in accordance with this Privacy Policy.

2. Interpretations and Definitions

2.1 Interpretation:

  • The definitions contained in clause 2.2 below shall have the corresponding meanings regardless of whether they appear in singular or plural.

    Words importing any one gender shall include the other genders.

2.2 Definitions:

  • Account” shall mean the unique account created for the user in order to access our Service or parts thereof;
  • Application” shall mean iServ Cloud, being the software program provided by our Company;
  • Company” shall mean Mia Telecomms (Pty) Ltd with registration number 1998/024633/07, being a company registered in accordance with the Laws of the Republic of South Africa, with registered address situated at 134 Walton Road, Carlswald, Midrand, Gauteng.
  • Country” shall mean South Africa;
  • Device” means any device (computer, cellphone or digital tablet) that access the Service;
  • Personal Data” means any information relating to an identified or identifiable individual;
  • Service” means the Application;
  • Service Provider” means individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company and to perform services related to the Service, which may include assisting the Company in identifying and analysing how the Service is used, from time to time;
  • Usage Data” means data collected automatically, either generated by the use of the Service, alternatively from the Service infrastructure itself.
  • User” means the individual accessing or using the Service, or the Company, alternatively the legal entity on behalf of which the individual is accessing the Service.

3. Personal Data

3.1  Download Procedure:

In order to allow the Service to be downloaded from the applicable marketplace, we process the information required to download it, being the user name, email address, customer number, time of download, payment information and Device ID. The aforementioned procedure is not done for our purpose and means and we are therefore not responsible for such collection data. The Company hereby confirm to only process said data to the extent necessary in order to download the Service onto the Device in question and for technical purposes related to the availability and development of the Service.

3.2  Types of Data Collected and Used by our Service:

While using the Service, the Service accesses, processes and generates the User’s Sim Card Contacts and consequently accesses the following information contained in the each Sim Card Contact, if applicable:

  • User Information
  • Contact Information
  • Traffic Data
  • Device Contact List (Upon User’s Consent)
  • Photo and Media (Upon User’s Consent)
  • Usage Statistics

The aforementioned Data is required for technical purposes in order to ensure ease of use for the Service and its functions, whilst also ensuring stability and security. This Data is only stored locally and is not uploaded to the Cloud after usage.

3.3 Use of your Personal Data:

The Company shall only process the User Information connected to each Profile, which consists of the User’s user name, password and phone number. The aforementioned Data is processed on the basis of the contractual relationship between the Company and the User.

3.4 Retention of Personal Data:

All Data collected in accordance with this clause 3 shall only be stored locally and will not be uploaded to the cloud. The Company shall therefore not retain or use the information gathered for any purpose other than mentioned in this code.  The Company shall furthermore not transfer any of the personal data to any other source.

3.5 Contact Information:

In the event that the User contacts us on our contact form, we will process the information required in order to answer the User’s query, which Data shall include the User’s email address, name and telephone number, as and if provided. The aforementioned information is processed on the basis of our legitimate interest to answer the User’s business related queries.

3.6 Traffic Data:

During use of our Service, we will process traffic data in order to facilitate communication. This will only be processed in the event that User’s communicate via the Service and will process information relating to calls made, the length of said calls and the current version of the Service used when making such calls.

3.7 Device Contact List:

During use of the Service’s functions, the Service will request consent in order to use the Device’s contact list. The Service shall only use such Data upon the User consenting to same. In the event where consent is not provided, the User may lose access to some functionalities within the Service.  We will therefore not use this data if you do not consent to the use thereof. You may subsequently grant or withdraw your consent at any time by using the settings in the Service (APP) or your operating system.

If you do consent, your device contacts will be accessible through the Service (APP). The data is stored on the device and on per single contact base, and the user can request to sync this data to our server in order to enhance the user experience. We process this data on the basis of your consent.

3.8 Photo and Media:

During use of the Service’s functions, the Service shall request consent in order to use the Device’s photos and media. The Service shall only use such Data upon the User consenting to same. In the event where consent is not provided, the User may lose access to some functionalities within the Service. The aforementioned consent or lack thereof, may at any time be amended by the User by providing or taking away such consent through the Service’s settings, alternatively the Device settings. The data is thereafter stored locally on the Device only. We process this Data on the basis of your consent.

3.9 Data Sharing

The Company has implemented generally accepted standards of technology and operational security in order to protect the User’s personal Data. All processing shall be done in accordance with the appropriate laws and regulations.

4. Legislative Measures

4.1 The Company understands the importance of protecting each User’s personal information and therefore undertakes to comply with all applicable guidelines and Data Protection Legislation in place.

4.2 The Company undertakes to ensure that all personal data remain confidential.

4.3 The Company and its employees are aware of the Protection of Personal Information Act, its guidelines and the risks associated with non-compliance thereof.

4.4 The user has the right to, at any time, request that any personal data be erased when such information is no longer needed for the purposes it was initially intended for, alternatively the user withdraws its initial consent or objects to any further processing of data.
